The Republican version of a department of homeland security changed the budgetary spending totals established in the earlier Budget Resolution. According to Senate rules, that change permitted any member to bring a point of order against the bill. Such a point of order requires 60 votes to dismiss. Progressives opposed the bill itself because it removed union protections for employees of the new department and included a number of provisions they considered unfair breaks for corporations. When Byrd (D-WV) raised the point of order, Progressives opposed attempts to waive it because they supported the Byrd's motion and wanted to kill the bill itself. However, even with many Democrats voting for the waiver, it passed, 69-30, and the bill met an important test of viability.
