This vote was part of the debate on the farm bill, the reauthorization of the federal government's many agricultural programs. Baucus (D-MT) proposed amending the farm bill to include $2.35 billion in emergency agriculture assistance, including $1.8 billion for a crop disaster program, $500 million for livestock, and $100 million for apple growers. According to Senate rules, a point of order is allowed if any spending change would exceed the totals set by Congress in the Budget Act, and 60 votes is required to waive the point of order. This emergency assistance qualified, and Lugar (R-IN) raised the point of order. This vote, the motion to waive the point of order, passed with nine votes to spare, 69-30. That allowed the amendment to pass on a voice (unrecorded) vote. Baucus had proposed a similar amendment to the economic stimulus package (Vote #2) and had faced a similar point of order, but that attempt did not receive the 60 votes necessary for the waiver.
