This vote was to confirm D. Brooks Smith of Pennsylvania, Bush's nominee for the 3rd Circuit Court of Appeals. Critics of Smith, including Progressives, argued he had a narrow view of Congress's powers to regulate that suited his conservative views on environmental and civil rights issues. They also attacked him for continuing membership in an all-male sports club more than ten years after promising the Senate he would quit when nominated to the District Court in 1988. With progressives voting against, he was confirmed by a vote of 64-35.
