As the Senate debated passing an economic stimulus package to boost the economy, a number of spending increases and tax cuts were proposed as amendments. Each faced a similar procedural point of order, because each potentially violated the spending and revenue levels proposed in Congress's original Budget Resolution. Sixty votes were needed to waive this point of order and bring such an amendment to a vote. The amendment at issue here was a combination of two earlier failed amendments, and the first to break the 60-vote barrier. It extended a 30 percent bonus business tax credit for capital depreciation by a year and increased for two years the rate at which the federal government matched state Medicaid spending. Progressives opposed the amendment, and so opposed waiving any point of order against it. Still, the waiver passed 62-33, and the amendment then passed by a voice (i.e., unrecorded) vote. |
